ANDILE LOAN MANAGEMENT — Terms and Conditions

ANDILE LOAN MANAGEMENT is a SaaS platform provided by ANDILE MTETWA INNOVATIONS PBC, trading in South Africa under ONLISAVE ECOMMERCE (PTY) LTD) ("we," "our," or "us").
By accessing or using the ANDILE LOAN MANAGEMENT platform ("Platform"), you ("Customer," "Institution," "you," or "your") agree to comply with and be bound by these Terms and Conditions.

 

1. Service Description

ANDILE LOAN MANAGEMENT is a cloud-based software solution designed to help financial institutions, credit unions, and lenders manage the full lifecycle of loans, including application, approval, disbursement, and repayment.

 

2. Eligibility

To use the Platform, you must be:

  • A registered business, legal entity, or authorized representative.
  • Compliant with local and national financial regulations in your country of operation.
  • Authorized to offer loan or credit services in accordance with applicable laws.

 

3. Account Registration & Access

  • You are required to register an account to access the Platform.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity occurring under your account.

 

4. Subscription and Payment

  • The Platform is offered on a subscription basis (monthly billing).
  • Subscription fees are based on the selected package (Starter, Professional, Enterprise).
  • Payments are non-refundable except where required by applicable law.
  • Failure to pay subscription fees may result in suspension or termination of your access to the Platform.

 

5. User Limits and Customer Limits

  • User limits and customer limits apply based on your subscription package.
  • Additional users or customer volume may require an upgrade or add-on purchase.

 

6. License and Restrictions

  • We grant you a limited, non-exclusive, non-transferable license to use the Platform.
  • You may not:
    • Copy, modify, or create derivative works of the Platform.
    • Reverse engineer, decompile, or disassemble the software.
    • Use the Platform for unlawful or unauthorized purposes.

 

7. Data Ownership and Privacy

  • You retain ownership of your customer data and loan data entered into the Platform.
  • We process your data in accordance with our Privacy Policy.
  • We will not sell or misuse your data.

 

8. Security

  • We implement industry-standard security measures to protect your data.
  • However, no system is 100% secure; you agree to implement your own additional security measures where required.

 

9. Platform Availability

  • We aim to provide 99.9% uptime of the Platform.
  • We may perform maintenance or upgrades which may result in temporary downtime.
  • We are not liable for any damages caused by Platform downtime.

 

10. Termination

  • You may cancel your subscription at any time.
  • We may suspend or terminate your access if you violate these Terms or applicable laws.
  • Upon termination, your access to the Platform and associated data may be disabled, subject to applicable data retention laws.

 

11. Limitation of Liability

  • We provide the Platform "as is" and "as available."
  • We make no warranties regarding the accuracy, completeness, or suitability of the Platform.
  • Our liability is limited to the subscription fees paid by you in the last 3 months.

 

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising out of:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your violation of any third-party rights or applicable laws.

 

13. Changes to Terms

We may modify these Terms at any time. We will provide notice of significant changes.
Your continued use of the Platform constitutes acceptance of the updated Terms.

 

14. Governing Law and Jurisdiction

  • These Terms are governed by the laws of the Republic of South Africa, unless otherwise agreed.
  • Any disputes will be resolved in the courts of South Africa.
